	Terms and Conditions This outline of tour conditions represents part of the terms of transaction stipulated in Article 12-4 of the Travel Agency Law, and the contract specifying services rendered for travel and other matters as stated in Article 12-5 of the Law. Destination Japan is a wholly owned subsidiary of H.I.S. International Tours (L.A.), Inc. (“HIS” below). Participation For the benefit of everyone on the tour(s), Destination Japan and HIS reserves the right to accept or reject any person as a tour participant, and to remove from the tour any participant whose conduct is deemed incompatible with the interests of the other participants. Travelers Who Need Special Assistance You must report any disability requiring special attention directly to a representative of Destination Japan and HIS at the time of reservation. Destination Japan and HIS will make reasonable attempts to accommodate the special needs of travelers, but it is not responsible in the event it is unable to do so, nor is it responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers. Be aware that outside the United States, facilities for disabled individuals are limited. We regret that we cannot provide individual physical assistance to a tour participant for walking, dining, getting on and off trains and other vehicles, or other personal needs. A qualified and physically able companion must accompany travelers who need such assistance. Any pre-existing physical (including allergies), mental, or emotional disability that may require attention or treatment must be reported in writing prior to the beginning of a tour. Failure to report such disabilities may result in refusal of the continuation of services for that participant, and no refund will be provided for services not yet rendered. Destination Japan and HIS tours are physically demanding: You will be doing a lot of walking and standing during the tour. You will be taking your luggage with you as necessary. Elevators and escalators can be hard to find, especially in the smaller train stations. Because public transportation is not always convenient, there may be times when you will have to walk up to 10 minutes with your luggage. Suitcases with rollers work fine in Japan, but there may be times when you will have to carry your luggage up and down stairs. Because of these reasons, only those who are in good health (no heart or back problems) should consider our tours. Young Travelers A parent or guardian must accompany travelers who are less than 18 years old on the date of departure. Smoking Destination Japan and HIS will make every effort to accommodate your request for a smoking or non-smoking room. However, we cannot guarantee we will be able to accommodate your request. Passports and Visas You are responsible for obtaining your passport, and for meeting all health and other requirements required by Japanese laws, orders, and/or requirements. Non-US citizens must consult with appropriate consulates to determine if any visas are needed. All travelers traveling internationally are required to have a passport. Safety Please be aware that during your participation in tours operated by Destination Japan and HIS, certain risks and dangers may arise beyond our control including, but not limited to, the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft, or other means of transportation; the forces of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities. Destination Japan and HIS will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that Destination Japan and HIS will use its best efforts to ensure that adequate measures are taken. Deposit and Final Payment A non-refundable deposit of $300 per person is required to complete a reservation. The remaining balance will be collected up to 30 days prior to commencement of services. If payment is to be made by check, checks must be received six weeks in advance of the commencement of services. Payment A deposit of US$300 is to be paid at the time of reservation. The remaining balance is to be paid in full one (1) month prior to the departure date. In the case final payment is made by check, checks must be received six (6) weeks prior to the departure date to allow for transit time and clearing. Included in the Tour Fare The following may eventually include items unrelated to the tour(s) you choose. Please note that the items included in the tour fare are only those as specified in each respective tour’s itinerary. Hotel Rooms: Rooms with private bath on a twin room basis (double occupancy) at the hotels specified in each itinerary. For single room occupancy by choice or circumstances, extra charges will be required. These extra charges vary depending on the hotel specified in the itinerary. Meals: Only the meals specified in each itinerary are included. Airfare: Economy-class seats on airlines specified in each itinerary. Transportation: Tickets and tips (if any) on any tour-related activity listed in the itinerary. Guide Services: At least one (1) English-speaking guide for sightseeing and excursions will be provided. Not Included in the Tour Fare Incidental charges and expenses other than those specified in the preceding article including, but not limited to, laundry, domestic and international phone calls, telephone rental, additional meals and drinks and any other expense of personal nature, US domestic air fares, excess baggage charges in respect to number and weight, medical expenses for injuries and illness, and traveling and accommodation costs between arrival and departure outside the duration of the tour itinerary. Revision of Contents of Services Destination Japan and HIS may at any time cancel the tour or revise its contents and services for any of the following reasons: natural calamity or disaster, weather conditions, suspension of services rendered by transport, accommodation, or service provider facilities, provision of transportation not based on the original operational plan, governmental orders, or other circumstances beyond Destination and HIS control. Destination Japan and HIS reserves the right to take necessary measures when safe, smooth tour operation in accordance with the itinerary is deemed impossible, or when there is valid reason to believe that the tour cannot continue. In such cases, Destination Japan and HIS must explain in a timely manner its inability to function according to the itinerary under the circumstances. However, said explanation may be made after revisions are made when conditions demand. Responsibility The carriers, accommodations, and other suppliers providing tour services are independent contractors and are not agents, employees, or servants of, or joint ventures with, Destination Japan and HIS or their affiliates. All travel documents for tour services issued by Destination Japan and HIS are subject to the terms and conditions specified by the supplier, and to the laws of the countries in which the services are supplied. If, after tour departure, the services included in the tour cannot be supplied, or there are changes in an itinerary for reasons beyond the control of Destination Japan and HIS, Destination Japan and HIS will arrange for the provision of comparable services. Any resulting additional expense will be payable by travelers and any resulting savings will be refunded by Destination Japan and HIS to its tour participants. Destination Japan and HIS reserves the right to accept or reject any person as a tour participant, to expel any tour participant from the tour, or to make changes in the itinerary whenever Destination Japan and HIS deems it necessary for the comfort, convenience, or safety of the tour participants. The tour participant agrees that neither Destination Tours nor HIS nor its affiliates shall be liable for any damage, loss (including personal injury, death, and property loss) or expense occasioned by any act or omission of any supplier providing tour services. Liability of Destination Japan/HIS and Exemptions Destination Japan/HIS shall not compensate for damages incurred by clients as stipulated in provisions if any of the following reasons apply: 1. Natural disasters, war, civil unrest, and alteration or cancellation of tour itinerary due to such causes. 2. Accidents during transportation or accommodations, damage by fire. 3. Cessation of services related to transportation or accommodation facilities, and tour itinerary alteration or cancellation owing to such causes. 4. Orders of either Japanese or foreign governments, immigration regulations, isolation resulting from infectious diseases, and tour itinerary alteration or cancellation owing to such causes. 5. Accidents occurring during the client’s free activities. 6. Food poisoning. 7. Theft. 8. Delays, stoppages, changes of schedule and route in relation to transportation facilities, and tour itinerary alterations and-or shortened stays at destinations owing to such causes. Liability of Client Destination Japan and HIS shall require the client to indemnify Destination Japan and HIS for losses sustained owing to a client’s willful negligence, fault, conduct against public order and good manners, or breach of provisions in the Tour Contract. 1. The client is required to make every effort to utilize information acquired from Destination Japan and HIS and to understand the details of his or her rights and responsibilities as well as the details of tour conditions. 2. After the start of the tour, if a client should find that the tour service provided is different from that specified in the itinerary, the client is required to report the discrepancy to Destination Japan and HIS immediately. Cancellation and Cancellation Fees After a tour is confirmed, there will be a penalty for cancellations. Between the date of tour confirmation and 30 days prior to departure, a US$300 cancellation penalty will apply. Less than 30 days prior to departure: 25% of tour fare as cancellation penalty. Less than 15 days prior to departure: 50% of tour fare as cancellation penalty. On the departure day: 100% of the tour fare as cancellation penalty. Privacy Policy Destination Japan and HIS will use the personal information provided only for communicating with clients and for arranging transportation, accommodation, and services as necessary in order to provide the services requested by the client.
